Is there a misrepresentation? I'm not sure I see the basis for a claim. I'm not sure there is one either because I know so little about what this phone really is and does. If it is just a marketing ploy and is basically just a standard rebranded phone sold at a giant markup to rubes, then probably not. On the other hand, if it has included customized software and apps that are preloaded or available through some sort of 'app store' and those apps aren't vetted or supervised in any way for, you know, 'freedom' reasons then that liability landscape may be quite different. But, again, I know diddly squat about product liability so maybe not.

I guess being racist, inciting violence, and before a major advocate of American fascism makes you unpopular in the Left Coast. Who could have foreseen that. And Anaheim is home to Disneyland. It is accustomed to dealing with large crowds, but not to crowds that will start fights with counter protesters (or vice versa). After what happened with an appearance of Congressmember Katie Porter two weeks ago, I'm sure the city was concerned that a much larger scale battle could break out.

It took years for David Frum to break and admit the reality of the Republican Party. There are still those who can't. Whenever they can stomach criticizing the right they pathologically have to head for the "both sides are to blame" trope. Here's Meghan McCain, a classic case of name recognition welfare, desperately clawing to equate McCarthy and Pelosi. It's beyond pathetic. Unfortunately she's not the only one.
I'd say that the position Biden has taken is a bit different. He has given them the option to work together but he's more of a realist. Looking at the COVID relief bill and the handling of the infrastructure bill it looks like a case of "here's your chance but you're not going to use it to block our agenda." Pelosi did the same with her willingness to give in to every one of the House Republicans' demands for an independent investigation. Did she assume that McCarthy was playing the same old Republican games and that giving in wouldn't mean a thing? Maybe. She's politically savvy and a lot smarter than Kevin. But that doesn't really matter. The offer was on the table and Republicans swatted it aside. At this point they're relegated to whining.
At each turn the Democrats have given the Republicans an opportunity to work together. At each turn the Republicans have engaged in their predictable little play acting for the base. But unlike before the Democratic leadership doesn't give the Republican words about bipartisanship a shred of credibility. The boys who cried wolf now have to put up or be ignored. Good. Should have happened a long time ago.

The sad thing is that Democrats ignoring the Republicans' subterfuge and falsity won't add up to Democrats getting more votes. It certainly won't move those who identify themselves as Republicans to even consider voting for a Democrat. I learned that in the Obamacare debate years "discussing" with old friends about how Republicans really were included in the formation of the bill. They never believed it. The modern Republicans are no better and are probably more disinclined to believe it.
