After spending months amplifying former President Donald Trump’s false claims of a stolen election, Newsmax finally issued a statement on Friday that acknowledged there was “no evidence” to support claims promoted on its air that Dominion Voting Systems and one of its top employees, Eric Coomer, manipulated 2020 election results.

In the statement published Friday, the conservative news network said that while it had initially covered claims by President Trump’s lawyers and supporters about widespread voter fraud it “subsequently found no evidence that such allegations were true.”

The network had been particularly dogged in its promotion of conspiracy theories that Dr. Eric Coomer, the Director of Product Strategy and Security at Dominion Voting Systems had played a role in manipulating voting machines and the final vote counts in the 2020 presidential election.

But now, months later, the company is acknowledging that extensive recounts and audits in a number of states falsely attacked by Trump and his allies, do not support those claims.

“Many of the states whose results were contested by the Trump campaign after the November 2020 election have conducted extensive recounts and audits, and each of these states certified the results as legal and final,” the company said.

In its statement, Newsmax said it had found no evidence that Coomer had manipulated voting machines.

“Newsmax has found no evidence that Dr. Coomer interfered with Dominion voting machines or voting software in any way, nor that Dr. Coomer ever claimed to have done so,” the statement said. “Nor has Newsmax found any evidence that Dr. Coomer ever participated in any conversation with members of ‘Antifa,’ nor that he was directly involved with any partisan political organization.”

Dominion Voting Systems is already suing Rudy Giuliani personally for defamation. It’s now pulling the former mayor and currently suspended lawyer into its suit against Fox News.

Bloomberg was first to report on the development yesterday. Giuliani has been issued a subpoena as part of the voting machine company’s defamation suit against the news network, requesting all documents related to his appearances on Fox News dating back to 2016. The subpoena also seeks any communications the former president’s former lawyer had with the network about the 2020 election and Dominion.

The subpoena also asks for communications Giuliani had with Fox News about the “truth or falsity” of any of the outlandish claims he made about the voting machine company during his various Fox News hits. It also wants records related to Giuliani’s “formal or informal” relationship with right-wing news network.

This is all according to a Delaware state court filing from earlier this week, which Bloomberg was first to surface.

Fox News is trying to dismiss the Dominion suit and Giuliani is trying to do the same with the defamation suit against him personally. The company has also sued former Trump campaign Kraken lawyer Sidney Powell and the MyPillow guy Mike Lindell (who is trying to help Trump coup again, claiming the former president will be reinstated to the White House by August, whatever that means).

Both Lindell and Powell have sought to dismiss the suit, too. The trio plus Fox News were some of the biggest public hypers of conspiracy theories not only surrounding the 2020 election broadly but also specifically went after the voting machine company — making bizarre allegations that it was somehow working with foreign governments, Democrats and communists to keep Trump from winning the election.

The crank conservative news networks One America News and Newsmax have become the latest entities to be sued by Dominion Voting Systems for spreading lies alleging it rigged the 2020 election against Donald Trump. Dominion, one of the biggest voting-machine companies in the U.S., filed the twin lawsuits Tuesday. According to The Wall Street Journal, the company accuses the two outlets of harming its reputation by spreading ridiculous claims that its machines somehow switched votes from Trump to Joe Biden. Dominion is reportedly seeking more than $1.6 billion in damages in each of the lawsuits. “Newsmax helped create and cultivate an alternate reality where up is down, pigs have wings, and Dominion engaged in a colossal fraud to steal the presidency from Donald Trump by rigging the vote,” one of the suits states.

In a statement sent to Daily Beast reporter Diana Falzone, Newsmax claimed that “in its coverage of the 2020 Presidential elections, Newsmax simply reported on allegations made by well-known public figures, including the President, his advisors and members of Congress—Dominion’s action today is a clear attempt to squelch such reporting and undermine a free press.”

I guess Newsmax felt they had to say that but they know, beyond a shadow of a doubt, that Dominion's lawyers have hours and hours and hours of video of their people lying. Thoughts and prayers, motherf***ers.

Monday, Jan. 25, just might be remembered as the beginning of the end for wild right-wing disinformation—the day that Trumpists finally started paying a price for spreading lies that they knew to be lies.

And not just any price, but 1.3 billion-with-a-b dollars. That’s what Dominion Voting Systems is demanding in a defamation lawsuit (PDF) against Donald Trump’s personal attorney, Rudy Giuliani, for his alleged role in spreading “the Big Lie” about election theft.

I’m sure that Rudy, who says that he’s a crazy guy and that he’ll be countersuing since the suit by America’s second largest voting equipment maker is just “another act of intimidation by the hate-filled left-wing to wipe out and censor the exercise of free speech, as well as the ability of lawyers to defend their clients vigorously,” has that kind of money lying around. After all, he was paid so handsomely by the Trump campaign. Just kidding!

Dominion’s allegation is simple: "Just as Giuliani and his allies intended, the Big Lie went viral on social media as people tweeted, retweeted, and raged that Dominion had stolen their votes. While some lies — little lies — flare up on social media and die with the next news cycle, the Big Lie was different.” The suit’s 107 pages are filled with example after example of Rudy being Rudy and maligning Dominion in the process, undeterred by legal letters, underlying facts or anything else.

The suit includes this incredible sentence, about how “Dominion was not founded in Venezuela to fix elections for Hugo Chávez. It was founded in 2002 in John Poulos’s basement in Toronto to help blind people vote on paper ballots.” Nonetheless, Giuliani went on Maria Bartiromo’s show to declare that Dominion “was founded by Chávez and by Chávez’s two allies who still own it,” that “it’s really being run by people that are close to Maduro and Chávez,” and that the company “has tried and true methods for fixing elections,” and that Dominion “notifies” election officials when they are too far behind so they can add in fake ballots.”

It finishes with this.

The founder of Dominion pointed to a larger, more important theme for these lawsuits in a statement: “Not only have these lies damaged the good name of my company, but they also undermined trust in American democratic institutions, drowning out the remarkable work of elections officials and workers, who ensured a transparent and secure election. The thousands of hand recounts and audits that proved machines counted accurately continue to be overshadowed by disinformation.”

From Hillary Clinton’s health to Joe Biden’s mental state, Trump and his boosters in the far-right media have spread lies for years with no consequences. But now there’s a real chance that Rudy is just a warm-up act for the big legal show to come.

“We’re not ruling anybody out,” the company’s lawyer said on Monday. “Obviously, this lawsuit against the president’s lawyer moves one step closer to the former president and understanding what his role was and wasn’t.”

And if there’s one thing we know for sure that Trump doesn’t like, it’s paying other people money.

Dominion Voting Systems has filed yet more defamation lawsuits over false statements about the 2020 elections, requesting $1.6 billion in damages each from Newsmax, One America News Network, and ex-Overstock CEO Patrick Byrne.

The suits add to a growing list for the voting machine manufacturer, which has separately sued former Trump lawyers Rudy Giuliani and Sidney Powell, MyPillow CEO Mike Lindell and Fox News.

The complaints spend dozens of pages walking through the ragtag cast of characters that’s fueled lies about the 2020 election. Both Byrne and OANN, for example, promoted Edward Solomon, who they characterized as an expert mathematician who had evidence that Dominion machines manipulated votes.

In fact, Dominion’s OANN suit alleged, Solomon was no “expert mathematician” but rather “a convicted drug dealer who never graduated college and whose current job was setting up swing sets in Long Island, New York.”

“OAN manufactured, endorsed, repeated, and broadcast a series of verifiably false yet devastating lies about Dominion,” the suit against that network, filed in federal court in Washington, D.C., alleged. The same claim was made in a Delaware court against Newsmax. The complaint against Byrne was also filed in federal court in D.C.

In a statement to TPM, Byrne doubled down.

“Between the imminent release of the Maricopa Audit, and Mike Lindell’s current activities in South Dakota, Dominion Voting is about to have a very difficult week. They are simply doing this as a distraction,” he said.

As Rudy Giuliani’s legal bills have piled up in recent months—and as federal investigators intensify their probe into Donald Trump’s longtime associate—the former president appears willing to provide just as much help as he usually does when his friends are in need: next to nothing.

For months now, Trump has consistently ignored or rejected Giuliani’s pleas for assistance. And it’s not just that Trump and other prominent Republicans have been unwilling to open up their wallets or war chests to help offset Giuliani’s mounting legal costs; in many cases, Giuliani’s former Trumpworld comrades have declined to even acknowledge the existence of his legal defense fund, which has struggled to raise much of anything from the public.

“There have been times when I’ve asked people in the [former] president’s orbit to see if Trump wanted to draw attention to the fundraising,” said an ally and longtime associate of the former New York City mayor. “That went nowhere. Many of these people wouldn’t even tweet or retweet [links to the legal fund] when I asked them to.”

A billion-dollar Sword of Damocles continues to hang over the heads of some of Donald Trump’s closest allies.

Former Trump campaign lawyers Sidney Powell and Rudy Giuliani, and pillow magnate Mike Lindell, wanted a federal judge to make their problems go away — to dismiss the $1.3 billion defamation lawsuits they each face for their alleged lies about the 2020 election.

But on Wednesday, the judge did basically the exact opposite, saying that Dominion, the voting machine maker, has a real case.

With a 44-page opinion, U.S. District Judge Carl J. Nichols denied motions from Powell, Giuliani and Lindell to dismiss the lawsuits.

In short, Nichols explained, a reasonable juror could conclude the defendants expressed or implied a verifiably false fact about Dominion.

“This is not a close call,” Nichols wrote, referring to Powell. The judge offered a post-election example.

On Nov. 17, the Trump lawyer appeared on Newsmax and claimed to have evidence of Dominion’s founder admitting that “he can change a million votes, no problem at all.”

Powell said she would “tweet out the video later” — but she never did.

“These statements are either true or not; either Powell has a video depicting the founder of Dominion saying he can ‘change a million votes,’ or she does not,” Nichols wrote.

Powell had argued that “no reasonable person would conclude that the statements were truly statements of fact,” and that she was instead speaking as an attorney and advocate for Trump’s campaign when she made her outlandish Dominion claims. But the judge wasn’t buying it.

“t is simply not the law that provably false statements cannot be actionable if made in the context of an election,” he wrote.

The judge found the arguments by Lindell and Giuliani to be similarly cut-and-dry.

Smartmatic, the voting tech company at the center of Trumpland’s 2020 election fraud conspiracy theories, is now suing both OAN and Newsmax, two pro-Trump media outlets that gleefully trafficked in those conspiracy theories as the ex-president tried to steal the election.

• Smartmatic is accusing the outlets of deliberately spreading misinformation about the company in pursuit of pro-Trump viewers who’d given up on Fox News (after all, Trump whined repeatedly how Fox wasn’t sufficiently sucking up to him during the election).

• OAN was sued in federal court in Washington, D.C.; and Newsmax was sued in Delaware state court.

• Newsmax claims the lawsuit is a “clear attempt to squelch the rights of a free press.”

• The two new lawsuits add to the veritable avalanche of Smartmatic’s suits against various Trump cronies, including: Fox News, Fox Corporation, Rudy Giuliani, Sidney Powell, Maria Bartiromo, Lou Dobbs and Jeanine Pirro

• Dominion Voting Systems has already filed defamation suits against OAN, Newsmax, Fox News, Giuliani and Powell.

Too bad we don't have restorative justice in the civil legal system. A financial amount paid by these companies to the plaintiffs will not ever come close to repairing the damage caused by them. MyPillow Guy Mike Lindell’s lawyers are refusing to comply with the discovery process for Dominion Voting System’s $1.3 billion defamation lawsuit against Lindell, according to a court filing on Monday night.

The filing was signed by attorneys representing Dominion, Sidney Powell, Rudy Giuliani and voting-systems company Smartmatic — which also hit Lindell with a defamation lawsuit earlier this month.

Other lawyers in the case indicated that the MyPillow magnate’s lawyers stopped showing up to meetings to figure out a schedule for the case the day after Dominion’s lawyer hit them with a request for documents.

“Lindell and MyPillow’s change in position on whether the Court ordered and the Parties engaged in a conference presumably reflects their effort to avoid responding to requests for production Plaintiffs served the day before,” the filing said.

Lindell’s defiance comes after U.S. District Judge Carl J. Nichols ordered all parties to figure out a schedule for the discovery process and additional motions. Dominion has requested that Lindell, Giuliani and Powell produce documents related to the remarks they issued about Dominion during media interviews, in addition to depositions, according to the new filing.

The new filing notes that Lindell’s lawyers informed others in the case on Jan. 6 that they won’t participate in the scheduling conferences going forward. It also points to Lindell’s lawyers’ plans to appeal Nichols’ rejection of their motion to dismiss the lawsuit to the Supreme Court.

Dominion is keeping the heat turned up not only on Pillowboy but also Rudy "Four Seasons" Giuliani and Sidney "Kracken" Powell. These idiots just couldn't keep their mouths shut even after the lawsuits were filed.

Dominion said that there was no “realistic possibility” that it would settle its $1.3 billion defamation lawsuit with Lindell and Big Lie lawyers Giuliani and Powell.

“Given the devastating harm to Plaintiffs, the lack of remorse shown by Defendants, and the fact that many of them continue to double down on their lies, Plaintiffs do not believe any realistic possibility of settlement exists,” lawyers for Dominion wrote in the filing.

New York Supreme Court Judge David Cohen on Tuesday shot down Fox News and several Fox anchors’ efforts to quash voting tech company Smartmatic’s $2.7 billion defamation lawsuit against them.

Cohen denied Fox, Fox Business anchor Maria Bartiromo and fellow Fox Business anchor Lou Dobbs’ motion to dismiss Smartmatic’s suit, which accuses all three of defaming the tech firm by peddling bogus conspiracy theories claiming Smartmatic had rigged the 2020 election against Donald Trump.

The judge rejected Fox’s argument that the outlet itself never specifically pushed those conspiracy theories, writing in his order that Fox still provided a bullhorn for Trump’s goons to spread them.

“Even assuming that Fox News did not intentionally allow this false narrative to be broadcasted, there is a substantial basis for plaintiffs’ claim that, at a minimum, Fox News turned a blind eye to a litany of outrageous claims about plaintiffs, unprecedented in the history of American elections, so inherently improbable that it evinced a reckless disregard for the truth,” Cohen wrote in a 61-page order denying Fox’s motion for dismissal.

Cohen also rejected Bartiromo and Dobb’s separate motions for dismissal, saying that Smartmatic had “adequately pleaded a substantial basis” for its claims that the Fox hosts had “acted with reckless disregard for the truth.”

These clowns appear to be off the hook, though. Too bad.

Smartmatic’s lawsuit also targeted Fox News host Jeanine Pirro, plus lawyers Rudy Giuliani and Sidney Powell, who repeatedly aired their bogus claims while appearing as guests on the network.

However, Cohen allowed Pirro and Powell to remove themselves from the lawsuit in his order on Tuesday. Pirro never accused Smartmatic specifically of stealing votes in the election, and Powell, a Texas resident, is outside of the New York Supreme Court’s jurisdiction, the judge wrote.

Cohen also dismissed some of Smartmatic’s claims against Giuliani. However, the judge gave the software company permission to try again.

I hope they follow up on Giuliani and continue to bury his lying ass in legal bills.

Conservative activist and former Fox News contributor Michelle Malkin played a key role in launching conspiracy theories about Dominion Voting Systems into the mainstream, where they became the basis of Donald Trump's "big lie" about his election loss, according to a new lawsuit.

Court documents from a defamation lawsuit filed by former Dominion election security officer Eric Coomer against Malkin, the Trump campaign, conservative media outlets One America News and Newsmax, and nearly a dozen other parties show that Malkin first highlighted false claims about vote-switching on her YouTube channel.

"Well, of course, we listened to Michelle Malkin's interview of Joe Oltmann when it came to be -- the Eric Coomer portion of our piece," testified OAN reporter Chanel Rion, who was also named as a defendant in the suit. "So they -- they ended up landing on our radar around the time that Michelle Malkin did her interview on Nov. 13 or so."

Malkin live-streamed her interview with Oltmann on Nov. 13, 2020, six days after major news organizations projected Joe Biden as the winner, and the Colorado businessman claimed to have months earlier infiltrated a conference call where Coomer allegedly assured members of "antifa" that he would ensure Trump would lose the election.

"I knew that he had been discussing Dominion Voting Systems, which is based here in Colorado, as a story of local interest," Malkin testified during her own deposition, "and because of everything that had happened post-election, I wanted to give him a platform to tell my audience exactly what he knew about it and why Eric Coomer's role might be of concern. I didn't know exactly what he was going to tell me, because after I had followed him on Twitter the day before, his account was deleted -- or rather -- let me amend that. He had been suspended from Twitter, permanently suspended."

Malkin was soon contacted by Lauren McLaughlin, a producer for Fox News host Sean Hannity's radio program, asking to be put in touch with Oltmann so he could provide a signed affidavit of his claims against Coomer and use them in a federal complaint, and she helped them exchange contact information.

"What I knew about how he came on to the phone call, what he was doing there, what he discovered, and why he realized it was important only became clear to me as we were doing the interview," testified Malkin, who admitted she did not ask Oltmann whether he recorded the conference call. "That was the reason for doing the interview in the first place."

Malkin said during the deposition that she did not consider whether Coomer was a public or private figure, but she invited Oltmann to make claims about him that she had not independently verified as part of her broader effort to raise questions about election integrity.

Delaware Superior Court Judge Eric M. Davis rejected a bid by Fox News’ parent company, Fox Corp., to toss out Dominion Voting Systems’ defamation lawsuit on Tuesday.

• The judge ruled that Fox Corp. chair Rupert Murdoch and his son, Fox Corp. CEO Lachlan, may have acted with “actual malice” when allegedly directing Fox News to peddle debunked conspiracy theories about Dominion voting machines.

• Rupert Murdoch himself had told Trump that he lost the election, the judge noted, yet Fox went ahead with the conspiracy theories anyway.

• That marks a second blow to Rupert Murdoch’s efforts to fend off Dominion’s defamation suits over Fox News’ coverage: Davis allowed Dominion’s massive $1.6 defamation suit against Fox News to proceed in December.

Dominion is pulling Bill Barr in to testify.

Former Attorney General Bill Bar has been subpoenaed in a $1.6 billion defamation lawsuit that Dominion Voting Systems has brought against Fox News, according to court records.

A filing dated July 8 in Delaware Superior Court revealed Barr was recently subpoenaed as part of Dominion’s lawsuit, which alleges Fox News knowingly pushed false claims about the voting machine company engaging in fraud as then-President Trump’s and his allies’ tried to boost lies about the 2020 election being stolen.

Dominion’s subpoena to Barr comes as the Jan. 6 Select Committee holds its public hearings on the multi-step election steal effort by Trump and his allies. In its first public hearing last month, the panel aired footage of Barr’s taped testimony in which he dismissed unfounded allegations that Dominion machines switched votes to hand Joe Biden a win as “complete nonsense” and “amongst the most disturbing” claims made at the time.

In a video posted in the wake of Trump's angry Truth Social tirade, in which he attacked both the "Perverts and Lowlifes of the Lincoln Project" and Fox News for airing the group's ads, Wilson posted a video where he dared the former president to file a lawsuit against him.

"Since you threatened to sue the Lincoln Project this morning -- go for it," Wilson said. "Go for it, b*tch. Come at me. I can't wait. We're delighted by the thought that you would try to sue us, Donald. Do it!"

Wilson then predicted, however, that Trump would back off his threats to file lawsuits.

"You're not going to sue anybody, Donald!" he said. "You're not going to do sh*t... you are weak, you are impotent, you are flabby, you are sitting there at the bridal suite at Mar-a-Lago or the bridal suite at Bedminster grinding your gears while wondering why the Lincoln Project, no many how many times you try to kill us, keeps coming at you."

Wilson then listed off a litany of Trump misdeeds, including stashing away top-secret documents at Mar-a-Lago and trying to block the peaceful transition of power by inciting a riot, before finishing off with a profane sendoff.

A federal judge on Monday shot down MyPillow CEO Mike Lindell’s request to throw out voting tech firm Smartmatic’s defamation suit against him and MyPillow.

A defamation lawsuit against Fox Corp., Fox News Network and Lou Dobbs can proceed toward trial, a judge ruled Monday after concluding that a Venezuelan businessman had made sufficient claims of being unfairly accused of trying to corrupt the 2020 U.S. presidential election to be permitted to gather more evidence.

The lawsuit filed last year alleged that businessman Majed Khalil was defamed by Dobbs on “Lou Dobbs Tonight” and in tweets.

It said the former Fox personality joined with attorney Sidney Powell on a December 2020 show to claim that Khalil and three others designed and developed programs and machines to corrupt the presidential election.

Lawyers for Fox and Dobbs had tried to convince U.S. District Judge Louis L. Stanton in Manhattan to toss out the lawsuit before evidence such as depositions and emails could be reviewed, but the judge said Khalil had sufficiently claimed that his reputation was harmed by false accusations.

The judge said Khalil may be able to argue to a jury that actual malice occurred because the defendants “repeatedly maintained their claims about Khalil long after Powell’s election fraud theories were challenged.”

He wrote that numerous reports declaring the falsity of claims against voting machine manufacturers Smartmatic Corp. and Dominion Voting Systems and rejecting Powell as a source of accurate information gave the defendants “reasons to doubt Powell’s veracity and the accuracy of her reports.”

Stanton said Khalil had sufficiently alleged that “the defendants purposefully avoided the truth, given the amount of public information regarding the lack of fraud in the election.”

The CEO of Dominion Voting Systems, a company that makes election voting machines, has filed a restraining order against a man he says was scoping out the company's Denver office.

A judge granted a temporary restraining order against the El Paso County man who documents say visited the Dominion office building, sought entrance to the offices, ranted about election security, and admitted to having guns in his car.

We're not naming the man because he hasn't been arrested or accused of a crime. It's also not illegal to have weapons in your car.

In signed affidavits, both Dominion CEO John Poulos and John Bronson, a Denver police sergeant, said they saw the man at the Dominion offices and saw a scope and rifle case in the back of his car on two different occasions.

Rupert Murdoch, the Fox Corporation chairman, is set to be deposed next week in Dominion Voting System’s $1.6 billion lawsuit against Fox News over its coverage of election fraud in the 2020 election.

The deposition will take place on December 13 at 9:30am ET and “will be conducted remotely, under oath and via videoconference,” according to a Monday court filing obtained by CNN.
