Rep. Nicole Malliotakis (R-NY) is Not Pleased with New York’s new congressional district map that was drawn and passed by the state’s Democrat-controlled legislature on Wednesday. Under those new lines, Malliotakis’ district would merge with a deeply liberal area of Brooklyn – and needless to say, that’s going to be a problem for her.

• Malliotakis accused Democrats of trying to “tilt the scale” during a Fox Business interview. “We know one thing from the Democrats this year: It is that if they can’t win by the rules, they’ll change the rules,” the Republican complained.

• It’s too bad that there wasn’t any legislation that Malliotakis could’ve voted for that would’ve prevented this from happening.

That last bullet point has me positively glowing with schadenfreude.

Interesting take on redistricting. The Republicans may be playing quite a bit of defense against demographics.

Another take that seems to view things the same way and, in fact, thinks the Democrats could pick up 2-3 more "likely" seats. This isn't a prediction that they'll retain the House by any stretch. It just shows that Republicans have squeezed nearly all of the juice out of gerrymandering and demographics are making it much more of a defensive weapon in some states.

You’ve likely seen from Kate Riga’s reporting that things were trending in this direction. But over the weekend, Dave Wasserman of The Cook Report announced that according to his analysis the Democrats are now the net winners of the 2020–22 redistricting process nationwide.

Take a moment to let that sink in. For much of last year people were assuming that Republican state legislatures were going to use redistricting to engineer a gerrymander that might put the House and thus functional control of the federal government out of the reach of Democrats for the next decade. But that’s not how it’s turned out. Wasserman now thinks Democrats are on track for a net 2–3 seat gain.

Bold good news and national suckage mine.

All that said, far from the doomsaying, it looks like Democrats will basically hold their own and end up with a national map that is slightly more favorable to them than the current one. This is no fluke, of course. It’s the product of an incredible amount of hard work across the country by the people who were saying how bad it might end up. It doesn’t mean the doomsaying was wrong. Kate Riga explained the various factors that went into this outcome in this post from late December. State and federal courts have been a bit less generous with Republican gerrymanders than expected — including racial gerrymanders. Republican states that had opted for commissions or other reforms held to the spirit of those reforms a bit more than expected. Democrats meanwhile pushed their advantage in the few states where they were able. New York is the key example here.

Another overarching trend is that in a number of states Republicans just didn’t quite go for it in the way that some observers expected. They didn’t push for every last advantage. But as Kate notes in that article one key reason is that in purple-trending states those advantages got harder to manage. It became harder to figure out where to put growing numbers of voters of color or white voters who were trending more liberal. This means, if you looked closely, Republicans were using the gerrymandering opportunity less to seek new advantage and more to shore up existing seats. That has led to a new national map which is both better for Democrats and also less competitive overall.

DeSatanist failed to get advance judicial air cover for what is bound to be a brutally gerrymandered map drawn up by the Republican lead legislature.

The Florida Supreme Court denied Thursday Gov. Ron DeSantis’ (R) attempt to get it to issue a preemptive opinion on redistricting maps still being crafted by the state legislature.

DeSantis wanted the court to weigh in on the legality of dismantling two of Florida’s four predominantly Black districts, a vision he laid out in a maximally aggressive map drawn by his office. The legislature did not consider DeSantis’ map and unusual attempt to involve himself in the process, prompting DeSantis to try to win over the ultra-conservative state Supreme Court to his side.

Democratic-backed groups called DeSantis’ effort an “ill-conceived attempt to hijack the process” and liberal lawmakers panned it as the governor’s bid to blur the separation of powers.

“The governor reads his own authority too broadly,” Rep. Sheila Cherfilus-McCormick (D-FL) wrote in her brief to the court. “The power to approve or veto laws does not make one a king, nor does it convert the Supreme Court to a privy council.”

Kansas GOP’s Second Shot At Map Veto Override Succeeds

After initially failing on Monday, Kansas’ GOP-controlled legislature had the votes on Wednesday and Tuesday to form supermajorities in the state Senate and House, respectively, to override Democratic Gov. Laura Kelly’s veto of the district map drawn by Republicans.

• Two Republican senators switched to “yes” on Tuesday after previously voting no. One of them switched after a separate Senate committee passed a measure requiring pharmacists to fill prescriptions for ivermectin. That lawmaker, who’s also a doctor, has admitted to prescribing ivermectin and is also under investigation by the Kansas State Board of Healing Arts.
    ○ The point is, horse paste apparently made it into a fight over gerrymandering somehow.

• Under the proposed map, Rep. Sharice Davids (D-KS) – the one Kansas Democrat in Congress – would face a tougher chance of holding onto her seat, according to the Kansas City Star.

When states started the all-important process of drawing the next decade’s congressional districts last year, Democratic officials were caught on the horns of a dilemma: Should they take the moral high road, or the road to a House majority?

There was no question about what Republicans would do. They’ve made no secret of their decades-long effort to draw the most lopsided maps wherever they had the power to do so.

But Democrats, having spent the last decade trying to end the practice known as gerrymandering, entered this round of redistricting squeamish about the idea they might propagate it themselves.

“I just don’t believe we justify our bad behavior based on theirs,” Rep. Dan Kildee (D-MI) told The Daily Beast in October.

Months later, it’s clear what path Democrats chose; the maps don’t lie. In New York, they wiped three Republican seats off the map with a stroke of Gov. Kathy Hochul’s pen. In Illinois, Democrats eliminated two GOP seats, dissecting the state into a burst of ribbons extending from the Chicago area.

Whatever squeamishness Democrats had, they apparently got over it. On Wednesday, Kildee told The Daily Beast that the GOP’s “continuing to use their power to tilt the scales” was Democrats’ main concern.

Hypocrisy? Not at all. All the Republicans have to do is agree that both sides give up this anti-democratic behavior and it all goes away. So far there hasn't been a remotely analogous Republican offer.

“We obviously have legislation that would change that,” Kildee said. “Until then, we’re gonna fight fire with fire.”

Asked if Democrats in his home state were justified in drawing their map, Sen. Dick Durbin (D-IL), chair of the Senate Judiciary Committee, started his answer with “under these circumstances,” and reiterated his support for reforms.

“I’m ready to vote for any approach that treats all states the same,” Durbin said. “I think if we have passion for reform in just the blue states, we’re foolish.”

Others are losing little sleep over Democrats’ aggressive map-drawing, even as Republicans attack them for hypocrisy on the issue.

“What would cause a greater crisis, frankly, is to allow just this completely uninhibited Republican gerrymandering… and there be no response,” Rep. Alexandria Ocasio-Cortez (D-N.Y.) told The Daily Beast. “I think that would actually be a much worse situation.”

Michael Li, senior counsel at the Brennan Center for Justice, a think tank and democracy advocacy group, told The Daily Beast that “both parties’ caucuses are about to get more polarized.”

The effect of that polarization, and the general weariness of the redistricting arms race, could prompt parties to reconsider solutions, Li theorized. “Having drawn blood on both sides, maybe tempers can cool and you can do something?” he said.

Until then, Democrats agree: The current process is helping to sap the already abysmal levels of public trust in government, and there’s basically nothing they can do about it for a long time, so long as Republicans oppose reforms and some Democrats oppose changing Senate rules to pass reforms without them.

“I hope what people see around the country is recognizing that the current system doesn’t work,” said Rep. Andy Kim (D-N.J.). “The hope is that, 10 years from now, we don’t have to have such a ridiculous process.”

And nothing but crickets from the Republican side on this issue.

Meanwhile California's Citizens Redistricting Commission announced that the 45 day time span for filing suit against redistricting maps passed without any suits being filed.  There is still time for someone to mount a referendum challenge which could send the question to the voters but it takes time to collect signatures to mount a campaign like that.

Even under court order Ohio Republicans just can't bear to obey the law. Now they're facing contempt.

The Ohio Supreme Court on Thursday ordered the state’s Republican-dominated redistricting commission to appear in person and explain why it shouldn’t be held in contempt of court for failing to draw fair state legislative maps.

The order to appear before the court came weeks after the state’s Supreme Court rejected maps from the commission for being overly partisan, in violation of a state constitutional amendment passed by Ohio voters in 2015.

The redistricting commission — which includes the state’s Republican governor, secretary of state and legislative leaders — submitted new proposed districts in early February, but the court again found them insufficient, saying that the commission had opted merely to switch a few competitive Republican districts into marginally Democratic ones — thereby “eliminating weak Republican districts and creating weak Democratic districts.”

The court, with Republican Chief Justice Maureen O’Connor leading the majority, ordered the commission to adopt a new redistricting plan for the state by Feb. 18. No plan came. So O’Connor ordered the defendants to explain in writing why they shouldn’t be held in contempt.

What followed was an olympic round of finger-pointing, cleveland.com reported, with Republican members blaming everything from lack of access to map-making software to the time crunch of the court-imposed 10-day schedule.

The Republicans asked the court to hold off on any contempt decisions, and to give them more time to present a workable map. (Democrats on the committee, who proposed a map that was rejected by the Republican majority, apologized for the commission’s failures.)

Maryland's Republican governor signed off on the latest map. The Dems attempted a bit of gerrymandering but were blocked by the courts.

Maryland GOP Guv Signs Dems’ New District Map

After a judge ruled that the congressional district map drawn by Maryland Democrats had been gerrymandered and subsequently tossed it out, Maryland Gov. Larry Hogan (R) signed a new map on Monday that’s likely to keep the state’s partisan makeup looking about the same as before, according to the New York Times.

• The rejected map would’ve given Democrats seven safe districts and gutted a red district to make it more competitive.

• Maryland is one of two states whose Democrat-drawn map was struck down in the courts over partisan gerrymandering. The other is New York, though the fight over the Empire State’s proposed map is still ongoing.

Judge Allows New York Dems’ Maps To Stay For Now

A New York appellate judge on Monday paused a lower court’s order to toss out New York Democrats’ congressional and legislative district maps.

• That means the new district lines, drawn to heavily favor Democrats, will remain in place for the time being, and that New York’s June primary will move forward as planned.

• The judge stated that he anticipated making a final decision on the maps within three weeks, if not sooner. He ordered the Democrats and Republicans in the case to attend a hearing this Thursday.

The most powerful politicians in Ohio are apparently willing to risk being held in contempt of court if it means they can pass state legislative maps gerrymandered in their own favor.

The politicians — including the state’s Republican governor, legislative leaders and secretary of state — are members of Ohio’s redistricting commission. And now, they could face consequences from the state’s Supreme Court for submitting yet another set of proposed state House and Senate maps that appear to violate state constitutional amendments against partisan gerrymandering.

After the Ohio Supreme Court rejected the commission’s third attempt at drawing the maps last month, saying for the third time that they unconstitutionally favored Republicans, the commission hired independent experts and appeared to be charting a different path toward fair and proportional legislative districts that mirrored the way Ohioans actually vote.

Then, with hours to go until the court’s midnight deadline last Monday, the commission set the independent mapmakers’ work aside and submitted their third map all over again, with just a few minor tweaks.

A Democrat on the commission called the map, introduced on the night of the deadline, a “farce.” And the court’s Republican chief justice, who has consistently sided with Democrats in finding the commission’s maps unconstitutional, gave the commissioners until Monday to respond to legal challengers’ motion to schedule a contempt hearing. The body’s Republicans responded with broadsides.

“The only persons benefiting from any threatened contempt proceedings are the out-of-state partisan special interest groups who are now weaponizing litigation in an improper effort to thwart the will of Ohio voters, interfere with the legislative process, and unconstitutionally dilute opposition voters,” attorneys for Gov. Mike DeWine (R), who is on the commission, wrote.

The governor’s filing accused legal challengers of attempting to “emasculate” the Ohio constitutional amendment dealing with redistricting.

Attorneys for Frank LaRose, Ohio’s Republican secretary of state, wrote that “The new Fourth Plan adopted by the Commission on March 28 is obviously not the Petitioners’ preferred plan, and it may not be the Court majority’s preferred plan. But it is a new Plan, which is what this Court ordered the Commission to adopt by March 28.”

The Rest of the Story: This has been a back-and-forth between the Supreme Emperor and his (Usually) Compliant Cadre of Cuckoos since the original legislative session opened months ago. Even the (Usually) Compliant Cadre had been balking mightily at Supreme Emperor's interference in something that the Legislature usually handles (often poorly, but that's another matter). The conventional wisdom had been that Supreme Emperor's proposal was a bridge too far, even for the Cadre of Cuckoos.

I've seen just the headline, and not much else. Wonder WTF happened to elicit the about-face? I'll check the local rag later.

A little more from the local rag. At its core, it's performative, sure to bring on litigation...and keep Supreme Emperor's name in the national news for months to come.

DeSantis in March vetoed a congressional plan approved by lawmakers that included a primary map that turned Lawson’s district into a Duval County-only district, but still with a 35% Black voting age population, and a secondary map that retained the Jacksonville to Tallahassee district and had a Black voting population of 43%.

The Republican leaders’ view was that if a court struck down the primary map as failing to meet state or federal redistricting requirements, the secondary map could be accepted, keeping the wide-ranging District 5 in place.

But DeSantis derailed that path with his veto. He acknowledged Tuesday that his approach is certain to be tested in a court.

“Obviously, that will be litigated,” DeSantis said. “But I can tell you, the original district would have absolutely been litigated. And if you look at what’s happened in the U.S. Supreme Court over the last four or five years, you know, that would be the case.”

DeSantis is relying on a 2017 U.S. Supreme Court ruling in a North Carolina case that found it unconstitutional to racially gerrymander a seat, except in narrow instances, which Lawson’s Jacksonville-to-Tallahassee district may not meet.

That North Carolina ruling came two years after Congressional District 5 was created by the Florida Supreme Court, which had taken over the map-making in the last round of once-every-decade redistricting because of constitutional violations by Republican lawmakers who drew the state’s initial maps.

DeSantis argues that federal law conflicts with the state’s voter-approved Fair Districts amendments, which prohibit line-drawing that for minority voters, “diminish their ability to elect representatives of their choice.

He knows full well what he's doing.

DeSatanist has created a map that completely destroys any meaningful level of democracy in Florida.

Two days after Florida’s Republican legislative leaders publicly announced that they would let Gov. Ron DeSantis (R) draw the state’s new congressional map — an unprecedented move in its own right — the governor released a map Wednesday afternoon that was wildly slanted in his own party’s favor.

In a state that’s leaned only slightly to the right in recent years, DeSantis’ map would likely give Republicans control of four new congressional districts and take three away from Democrats: A 20-8 split, up from a 16-11 split today. (The state gained a new congressional seat as a result of population growth as reflected in the 2020 census.)

The map is an exercise in raw political power by the governor, who proposed his own congressional maps months ago and then vetoed maps from the Republican-controlled legislature that were closer to the status quo, both unheard-of moves for a governor of the same party as legislative leaders. Early reports indicate the legislature is prepared to work with DeSantis’ map during a special session next week.

And though lawsuits will be filed against it, DeSantis’ map, if approved by the legislature, will likely be in use for one or even two congressional election cycles. And conservative courts could still preserve the map in Republicans’ favor.

That’s what the governor thinks, at least: In multiple memos in recent months, DeSantis’ top counsel has said Fifth Congressional District, which stretches along Florida’s border with Georgia, was unconstitutionally gerrymandered in Black voters’ favor.

The district, represented by Democratic Rep. Al Lawson (D) since 2017, was approved by the Florida Supreme Court after a legal challenge to the previous map.

DeSantis’ map not only redraws Lawson’s district, but also splits up Jacksonville, Florida’s largest city. The map also draws a whiter electorate for 10th Congressional District, currently represented by Rep. Val Demings (D), and makes Rep. Charlie Crist’s (D) district more conservative.

One unnamed Republican source told NBC News last month: “All of the constitutional lawyers [DeSantis] speaks with, both in the Federalist Society and elsewhere, believe that both Fair Districts and the Voting Rights Act when it comes to racial gerrymandering are illegal.” The same source claimed that DeSantis has been in regular contact with Supreme Court Justice Clarence Thomas.

Ohio Republicans have unlocked a secret of subverting their state’s constitution: Simply ignore your state’s Supreme Court when it tells you things you don’t want to hear.

That, literally, is what the most powerful politicians in the state have done with the ongoing fight over gerrymandering in Ohio: Four times in a row, the state Supreme Court’s majority has ruled that Republicans’ state legislative maps were unconstitutionally gerrymandered in their own party’s favor, and ordered that they draw a new map.

But rather than passing a map the court would support, the GOP-dominated Ohio Redistricting Commission simply… did nothing. They have not held any meetings since the high court’s last ruling.

They’re running out the clock. And it’s working.

On Wednesday, a federal court stepped into the redistricting process, ruling that they would order the state to use the commission’s third map — one of the four proposals that the state Supreme Court already rejected for being too slanted — unless the state produces a workable new map by May 28. Either that or the state’s Republican-majority General Assembly changes the state’s election deadlines. The primary is set for Aug. 2.

The majority of a three-judge panel in the Southern District of Ohio, two Trump appointees, agreed with right-wing plaintiffs that the delay in the redistricting process (caused by Republicans’ foot-dragging) threatened the voting rights of Ohioans.

If the commission and the state Supreme Court aren’t able to “set aside their differences,” they wrote, the solution is to go ahead with a map previously approved by the committee — one gerrymandered heavily in Republicans’ favor.

“[T]he fact that Map 3 does not comply with the Ohio Supreme Court’s interpretation of state law does not prevent this court from imposing it — for one election cycle only — when faced with federal law violations, other state law concerns, and concerns about election administration on a short timeline,” the majority wrote.

New York, unlike Ohio, actually believes in the law. In NY the Dems tried and failed. Done. In Ohio the Republicans delayed and succeeded. The state supreme court's decision was meaningless.

New York’s highest court said Wednesday that congressional and state Senate maps drawn by Democrats were unconstitutional, ruling that the maps violated procedural and substantive rules against gerrymandering.

The court said a court-appointed expert — called a special master — would now draw the maps instead of the legislature, and that the process would likely mean that the congressional and state senate primary elections would be pushed back to August.
