The insurrectionists are getting hit with a little used charge which is appropriate for a never before seen event.

As federal prosecutors increasingly use an obscure criminal charge to jail Jan. 6 insurrectionists, congressional investigators seem to be building a case that could result in that same charge against former President Donald Trump.

A third of the 700 people arrested by the Justice Department for attacking the U.S. Capitol building have been hit with a peculiar federal “witness tampering” law, according to researchers at George Washington University’s Program on Extremism. Those 240 insurrectionists have been charged with corruptly obstructing an official proceeding, a never-before-seen tactic by prosecutors for an equally unprecedented event.

So far, 12 have pleaded guilty, and three of those have already been sentenced. But if hundreds of people face prison time for interrupting Congress while it was certifying the 2020 election results, what happens to the president who ordered them to march there?

While the DOJ pursues the rioters, the special House Jan. 6 Committee is separately collecting evidence to formulate a picture about how this all came together. And legal scholars say a strategy is taking shape—one that builds a case to criminally charge the former president.

“The DOJ and the committee are building a pyramid of guilt to get to the top. The more people who plead guilty, the more the top of the pyramid begins to take shape,” said Joshua E. Kastenberg, a professor at University of New Mexico’s law school.

Rep. Liz Cheney (R-WY), one of the two GOP members on the congressional panel investigating the insurrection, first drew attention to that possibility during a televised hearing last week. That’s when she made an obscure reference to “another key question before this committee: Did Donald Trump, through action or inaction, corruptly seek to obstruct or impede Congress’ official proceeding to count electoral votes?”

On Monday, The New York Times pushed that idea further when it revealed that the House committee investigating the insurrection is considering referring Trump to the Justice Department.

I guess we'll see just who the ultra partisan hacks are on SCOTUS. I expect Thomas and Alito to instantly side with Trump. I don't have a feel yet for how shameless the other corrupt basic partisan hacks are.

It was bound to be a bitter fight to the very end.

The appeal could be Trump’s last-ditch effort to use the nation’s courts to slow down the work of the congressional committee, which is uncovering what role—if any—the Trump administration played in fomenting a violent mob attack on the U.S. Capitol to keep him in power.

Trump has already lost both initial rounds of this fight, with a federal judge noting that Trump doesn’t have the power of a king, and an appellate panel unanimously lambasting his pleas for having “no basis.”

This will be interesting.  Whether Trump knows it or not, the Justices he appointed have their own ideas about things, mostly religious "freedom", containing the regulatory state, and abortion.  They may not be too interested in supporting his outlandish claims.  It'll make them look bad. They already went out on a "we're not partisan" tour last fall.

I guess it's no shock that James O'Keefe is tied in with a fascist right-wing domestic terrorist organization.

A Justice Department investigation into conservative operative James O’Keefe and his Project Veritas group includes a review of O’Keefe’s ties to a member of the far-right Proud Boys, according to a federal search warrant.

On Nov. 6, FBI agents carried out an early-morning raid on O’Keefe’s home. The search came as part of a year-long investigation involving Project Veritas’s purchase of a diary purportedly belonging to Joe Biden’s daughter, Ashley Biden, and the diary’s subsequent publication on a right-wing website.

As part of the raid, according to the warrant, FBI agents were looking for communications with a self-described “third degree” Proud Boy named Jackson Voynick. Voynick is listed in the document as one of several persons whose communications could reveal information about “potential co-conspirators.”

The search warrant points for the first time to a Proud Boys link to the Justice Department investigation. Several high-ranking members of the far-right men’s group have been charged with alleged involvement in the Jan. 6 riot.

The Proud Boy connection to the Justice Department investigation, which began under Trump attorney general Bill Barr, has not been previously reported. The search warrant was filed in court records by O’Keefe’s attorneys in November, and first noted by journalist Marcy Wheeler.

Read this and explain to me why this isn't simply a dangerous fraternity of pathetic man-children who never managed to mature past adolescence.

In the 1970's Woody Allen wrote a short story for The New Yorker entitled "A Look at Organized Crime".  Here's the part about initiation rituals:

Lyndon McLeod, who police say killed five people during a deadly rampage in the Denver area, was an author dedicated to alt-right philosophies, including masculine supremacy, contrarian COVID-19 beliefs, and targeted violence against the “weak.”

McLeod appears to have operated a plethora of Twitter and Instagram accounts under the alias Roman McClay, which he used for his three-book series Sanction. The book series, with its first book described in an Amazon review as “eloquent reflections on dominance hierarchies, psychology, technology, nature, violence, anatomy and physiology, sexual morality, drug use, politics, and a whole mess of stuff,” follows a character named Lyndon McLeod, a persona named after its author who “commits 46 murders” in the book and one he seemed to allow to seep into his real life. The Daily Beast found that at least two Twitter users identified McLeod and McClay as one and the same months and even years before the shooting.

Those imprisoned and awaiting trial for alleged crimes related to the Jan. 6 insurrection have benefitted from a torrent of positive mail, thanks in part to one North Carolina militia group.

The Patriot Mail Project bills itself as a grassroots effort to support what its members regard as “political prisoners” — Jan. 6 participants who have been detained for their involvement in the Capitol insurrection. It’s operated by members of the Stokes County Militia, a North Carolina group that ran a similar campaign in support of the 2015 Bundy siege of the Malheur National Wildlife Refuge.

Paula Calloway, a member of the Stokes County Militia and organizer of the letter writing campaign, told TPM that she got involved in politics in 2010, over a local King, North Carolina controversy around whether the city could continue to hang a Christian flag on a public veterans’ memorial. Calloway was pro-flag.

The GOP’s right flank grew enraged at one of their own Wednesday, lashing out at Sen. Ted Cruz (R-TX) after the senator referred to the Jan. 6 Capitol attack as a “violent terrorist attack.”

“We are approaching a solemn anniversary this week,” Cruz said during a committee hearing Wednesday. “And it is an anniversary of a violent terrorist attack on the Capitol, where we saw the men and women of law enforcement demonstrate incredible courage, incredible bravery, risk their lives for the Capitol.”

That was simply too much for the right to bear.

Tucker Carlson said Cruz was among those “repeating the talking points that Merrick Garland has written for them.”

“It was not a violent terrorist attack, sorry!” Carlson commented after showing a clip of Cruz. “So why are you telling us it was, Ted Cruz?”

He added: “You’re making us think, maybe the Republican Party is as worthless as we suspected it was.”

Carlson’s was the most prominent of a wave of attacks on Cruz.

“I’m so done with Ted Cruz,” one-time White House staffer Sebastian Gorka said. “What are the odds he’s the senator who told President Trump not to speak tomorrow?”

The Party declares "2+2=5", and Winston Cruz failed.  It doesn't matter that it was a slip-up.
