Clarification on the Arizona terrorist threats against the top Maricopa County election official. They really are hell bent on stopping any election that doesn't automatically hand them power.

Nice scoop here. Local reports, one of which I picked up last night, had it that the top official in Maricopa County, Arizona had had to go into hiding after the midterms because of threats tied to the midterms. That’s not the case, though he still has additional security provided by the Sheriff’s Dept. It turns out, as Kaila Philo reports, that this happened on election night, when Republican Board of Supervisors Chair Bill Gates had to be taken to an undisclosed location under armed guard because of Big Lie-themed threats.

Ironically, it is often Republican elected officials who are the top targets of MAGA-aligned terrorist groups and paramilitaries.

Today we have a criminal complaint filed in the Eastern District of Michigan against Neil Matthew Walter who the United States government charges with making threats against the lives of Congressman John Garamendi (D-CA) and FBI Director Christopher Wray. On checking Walter’s Facebook page investigators found “numerous comments stating beliefs that half the Senators, the FBI, CIA, police, Tom Cruise, and Elon Musk are involved in a child slave rape ring, listing various locations where these rings are located, one of which identified the United States Capitol Building.”

In other words, yet another QAnon/MAGA domestic terrorist riled up by the endless parade of incitement usually centering on Democrats running pedophilia rings. Another player in the same bucket as the man who bashed in the head of Speaker Nancy Pelosi’s husband days before the midterm election.

Walter’s interest in Cruise and Musk just adds a bit of variety to the mix.

While they don’t appear to be directly related, I was reminded of this because just yesterday Rep. Matt Gaetz (R-FL) posted this antic snuff-film-esque “ULTRA MAGA” video which among other things suggests that the Jan 6th insurrection was in fact a false flag operation organized by the FBI to discredit the MAGA movement. The video focuses specifically on Christopher Wray. Gaetz says Republicans must reboot the Jan 6th committee as a pro-insurrection committee with the goal of “exonerat[ing] our patriots.”

The video builds to a crescendo with clips of Lindsey Graham and Kevin McCarthy who are presented as traitors to the MAGA cause because they, as shown in the video, said that the Jan 6th insurrection was a bad thing and that the participants should be punished.

Walter seems to have been focused on Democratic pedophilia rings, a la Pizzagate, rather than the Deep State plot which he, Gaetz and other MAGA diehards say was behind the Jan 6th insurrection. But the campaign of incitement against the institutions of the American state is all of a piece.

It’s all part of the same movement. Proto-fascist politicians inciting violence, the extremists and sometimes unstable individuals who act on those violent ideas. All of a piece.

Some Oath Keepers are headed for prison. 

A federal jury on Tuesday convicted Oath Keepers founder Stewart Rhodes of seditious conspiracy for leading a months-long plot to unleash political violence to prevent the inauguration of President Biden, culminating in the Jan. 6, 2021, attack on the Capitol.

The panel of seven men and five women deliberated for three days before finding Rhodes and a co-defendant guilty of conspiring to oppose by force the lawful transition of presidential power. Rhodes and all four co-defendants on trial were also convicted of obstructing Congress as it met to confirm the results of the 2020 election. Both offenses are punishable by up to 20 years in prison.

The defendant who was head of the Florida branch was the second one convicted of seditious conspiracy.  Now let's get to Roger Stone and his buds including Trump who encouraged all of this.

Judge says Trump can be sued over inciting the Jan 6 Republican Insurrection.

Former President Trump flailed and moaned after the November 2020 election — a tantrum of proportions so huge, a federal judge says, that he won’t get the legal immunity that typically protects presidents from lawsuits.

The ruling came from a familiar place: U.S. District Judge Emmet Sullivan for the District of Columbia, who held in a Monday opinion that Trump could face civil suit over his attempts to block the 2020 election.

Sullivan loomed large during the Trump years as he oversaw the prosecution, guilty plea, reverse guilty plea, and investigation into Michael Flynn, Trump’s national security adviser.

Now the first of several civil rights lawsuits brought against Trump for his attempt to subvert the 2020 elections is before Sullivan.

In the Monday ruling, Sullivan held that the lawsuit, brought by the NAACP and a Michigan group that advocates for low-income people, could proceed — in part because Sullivan found Trump’s actions to be so outrageous that the immunity that’s generally offered to presidents for actions taken in office can be pierced.

“If Former President Trump disrupted the certification of the electoral vote count, as Plaintiffs allege here, such actions would not constitute executive action in defense of the Constitution,” wrote U.S. District Judge Emmet Sullivan for the District of Columbia in a Monday ruling. “For these reasons, the Court concludes that Former President Trump is not immune from monetary damages in this suit.”

Sullivan cited an ongoing prosecution of a January 6 rioter allegedly affiliated with the Proud Boys in his ruling, stating what may seem obvious but apparently needs clarification: That a president “cannot, within the confines of his constitutional authority, prevent the constitutionally mandated certification of the results of a Presidential Election or encourage others to do so on his behalf, nor can he direct an assault on the coequal Legislative branch of government.”

Sullivan’s ruling marks a significant point in civil litigation over the 2020 subversion attempt, allowing a former president to be held civilly accountable for actions taken in office.

In a terrorism advisory bulletin, the Department of Homeland Security on Wednesday raised concerns about potential threats to the LGBTQ, Jewish and migrant communities from violent extremists inside the United States.

Americans motivated by violent ideologies pose a “persistent and lethal threat,” a senior DHS official told reporters in a briefing on the bulletin. Intelligence officials across the federal government have consistently highlighted the growing threat of American extremists in recent years, while explaining that foreign threats such as the Islamic State terrorist group and Al Qaeda are no longer as persistent as they once were.

The bulletin was the latest summary of national terrorism threats, a document that has been updated about every six months since the insurrection at the U.S. Capitol on Jan. 6, 2021.

Some extremists have been inspired by recent attacks, including the shooting at the LGBTQ bar in Colorado Springs, Colorado, the bulletin said.

The report also highlighted an “enduring threat” to the Jewish community.

Tommy Frederick Allan says he knows he’s going to prison, that after scaling the walls of the U.S. Capitol on Jan. 6, 2021, on a rope, stealing an American flag and some documents from the Senate chamber and later declaring on social media that it was the “best day ever” he faces some sort of punishment. He just doesn’t think he deserves the two years in prison federal prosecutors are seeking. “What I did on January 6th was wrong,” Allan wrote in a letter to the federal judge who is scheduled to sentence him next week in Washington, D.C. “I deserve to be punished.

But no too much because he didn't really DO anything.

“Mr. Allan was never really engaged in politics until the former President Trump convinced him and millions of other constituents of his unique and drastic ‘America First’ policies that promised freedom and prosperity for people like Mr. Allan, ‘The forgotten man’ — who owned a small business,” Jacob wrote. “Based on this, Mr. Allan gradually became an avid supporter. “When President Trump lost the 2020 election, he was also successful in convincing Mr. Allan not only that there was corruption and voter fraud but that the American citizens were responsible for doing something about it.” That led Allan, an Army veteran, father and owner of a Roseville toddler gym, to travel to Washington for the “Stop the Steal” rally that preceded the insurrection at the Capitol.

Allan faces sentencing Thursday in Washington, and Jacob argued that he deserves leniency in part because he “was not part of any organized group, did not engage in any pre-planning, and was completely alone.” “Despite some of his exaggerated Facebook posts that the government displays in its sentencing memorandum, Mr. Allan actually came to D.C. as a Trump fan — not wearing battle gear or carrying weapons — but simply wearing a winter Trump hat, blue jeans, and a hooded sweatshirt,” she wrote.

As for climbing a rope to scale the Capitol walls, Allan simply was trying to get a better view of what was happening, Jacob wrote.

“As Mr. Allan approached the Capitol building, he observed (throngs) of people crowding the stairway on the capital grounds climbing ropes up the wall, which prompted him to post (they’re) ‘storming the Capitol, they’re literally storming the walls,’” she wrote. “As Mr. Allan stood on the northwest lawn, he was curious to see what was occurring on the Upper West Terrace above but his vision was obstructed by the retaining wall and the nearby wide staircase was clogged with (hordes) of people. “Mr. Allan noticed that a rope was dangling from the nearby staircase wall and figured this was his only hope of viewing what was happening on the Upper West Terrace above. Mr. Allan climbed the rope and began to walk to the northwest courtyard; notably not seeing any police activity.”

Once inside, he saw that portions of an office had been ransacked, but he “did not approve of the actions of other rioters who had caused this damage,” she wrote. “He did notice a flag close by in the hallway which had become ajar from its stand and he grabbed it,” she wrote, adding that he later handed it over to police.

“As disturbing as Mr. Allan’s behavior was, he did not want to see the Senate Chambers damaged,” she wrote. “Unfortunately he did take some papers out of curiosity and he deeply regrets doing so. “These papers were a calendar for that day and Mr. Allan later boasted to other rioters that he took it off Mitch McConnell’s desk, which was obviously not true. Mr. Allan was only in the Senate chamber for 5 minutes. At that time, he left immediately when officers instructed them to do so and surrendered the flag peacefully and followed officer commands.”

The fun stops when you get arrested I guess.

At least five electricity substation attacks in Washington and Oregon in November were reported to the FBI, according to local media. Utility companies Puget Sound Energy, the Cowlitz County Public Utility District, and Bonneville Power Administration (BPA) told the Seattle Times they were cooperating with a federal investigation, though the FBI declined to confirm it was investigating the attacks. It’s not clear if any power outages resulted from the assaults. One operation described as a “deliberate physical attack” took place at a Clackamas, Oregon, substation over the Thanksgiving holiday, BPA spokesman Douglas Johnson said. News of the attacks in the Pacific Northwest comes after damage from a substation shooting in North Carolina on Saturday plunged tens of thousands of people into darkness.

Reporters in Los Angeles pointed out there was a substation shot out there in 2013. Similar attack...no one was ever arrested, not even suspected.  I guess there was no surveillance there.  Maybe a test case from way back.

Republicans are tearing at each other, just as you'd after poor election results. This particularly pair of hissy fits are over Andy Biggs not lining up behind Kevin "Spine Free Since '83" McCarthy. (1983 was the year he turned 18 so I'm just assuming.)

A skirmish between shouty Fox News host Mark Levin and several conservative congressmen who’ve stood in the way of Rep. Kevin McCarthy’s House speakership has turned into an all-out war.

Late Tuesday afternoon, far-right Rep. Andy Biggs, one of the five members who took an insult-laden verbal lashing from Levin last week, fired back at the right-wing talk radio host with equal ferocity.

“Levin is the biggest fraud in politics right now. For years, this guy castigated McCarthy publicly (with no shame). Now, he is all in for him and wants his audience to turn a blind eye,” Biggs declared on Twitter. “Total fraud.”

The Arizona congressman’s tweet was paired with a photoshopped image of Levin holding a pair of flip flops while standing on a fictional Flip-Flop Island. “Total Fraud & Flip-Flopper,” the graphic labeled the Fox host. The image also included several old quotes showing how Levin had previously ripped McCarthy as being a “RINO dimwit” and “BOUGHT AND PAID FOR”—fighting words in Trumpworld.

From there, the name-calling has only grown more intense.

On his Tuesday evening radio show, Levin responded to Biggs’ tweet by calling him “a phony, a fake, and a fraud.” (While Levin bills himself as ideologically consistent over the years, he most notably was a “Never Trumper” before becoming the ex-president’s informal picture book hype man. Likewise, his views on McCarthy appear to have evolved over time.)

Other speakers at the Park Avenue event also deployed contentious rhetoric. The president of the Young Republican hosts, Gavin Wax, called for “total war” against liberals.

A Puyallup couple have been charged with illegally entering the U.S. Capitol and engaging in disruptive behavior during the Jan. 6, 2021, insurrection in Washington, D.C.

Scott Roy Christensen, 49, and his wife, Holly Dionne Christensen, 44, are named in charges unsealed in U.S. District Court in the District of Columbia late last month. They have been ordered to appear before a U.S. magistrate judge Thursday to enter pleas, according to the court docket.

Christensen is a former Realtor who worked in California and Colorado before moving to Puyallup, where he sold real estate and later became a pastor at the Renovo Church of Christ in Tacoma in 2015. Washington business records indicate the church closed earlier this year. According to records, he also worked as an associate youth pastor at the Rainier View Christian Church in Tacoma.

The alleged crimes are misdemeanors, punishable by up to a year in prison and a maximum fine of $100,000.

The insurrection had so many moving parts...some coordinated maybe but there hasn't been talk of some sort of grand strategy. There are OathKeepers doing their thing, Proud Boys, people like this traitor giving tours of underground spaces, the fake slates of electors circulating, the folks texting with Meadows on election theft ideas but nothing pulls it all together.  That's probably a big reason for the failure of the coup...lack of coordination.  Instead there are a bunch of people working to keep Trump in office in their own unique ways.  

I badly want Roger Stone indicted.  I feel in my bones that he is at least involved in the Oath Keepers and Proud Boys activity.  He needs to be in jail.

A new court filing alleges Kelley obtained a list of over 35 law enforcement personnel who investigated him.

Kelley then discussed plans to kill the officials with an acquaintance, the filing alleges.

A man already being investigated for his role in the January 6 riots has been hit with additional charges after being accused of planning to kill the law enforcement officers who investigated his case, according to a criminal complaint unsealed on Friday.

Tennessee resident Edward Kelley, 33, allegedly obtained a list of law enforcement officials and discussed plans, starting December 3, to kill these officials with Austin Carter, 26, and a witness who eventually reported their activities to authorities, the complaint says.

Kelley, who was one of the first people to enter the Capitol grounds on January 6, was previously charged with assaulting, resisting, or impeding officers, civil disorder, destruction of government property, and seven other charges for his role in the Capitol riot.

According to the complaint, a witness who was interviewed by the FBI said Kelley handed Carter an envelope with a document of the names, titles, and phone numbers of approximately 37 law enforcement officials who investigated him and were "present at arrest or home search" of Kelley on May 5, 2022.

"I don't know what they'll do with the inauguration. I don't expect this to be wrapped up by the 2nd. But I know that there is case history in Arizona where someone was inaugurated and then the contest was successful, and that governor was removed from office," Bobb said. "So there is history for this."

Bobb appeared to be referring to the case of Thomas Campbell, who was initially declared to be the victor in Arizona's 1917 gubernatorial race. However, a court later sided with his opponent, George Hunt, who challenged the election results. Campbell was then removed from office after serving for less than a year.

Bobb added that she is "not too worried" about whether Hobbs gets inaugurated, as she believes Lake stands a chance at winning her lawsuit.
